Version 2026-09 · v1
Terms and conditions of use
These terms govern the use of www.caracolhn.com, its versions in other languages and the services CARACOL provides through it (together, "the platform"). By browsing, creating an account, listing a property or sending a request, you accept these terms. If you do not agree, please do not use the platform.
1. Who we are
The platform is operated by Caracolhn, with tax ID (RTN) pending registration and registered address in San Pedro Sula, Honduras, trading as CARACOL Real Estate or Bienes Raíces Caracol ("CARACOL", "we"). You can write to us at info@caracolhn.com.
2. What CARACOL is and is not
CARACOL is a real estate platform that publishes listings of properties for sale, for rent and new developments in Honduras, and provides real estate brokerage services through its team and verified agents.
- CARACOL does not own the listed properties unless the listing says so.
- Publishing a listing does not make CARACOL a party to any sale or lease the owner may sign with a buyer or tenant. The brokerage relationship is governed by the brokerage or marketing agreement signed by the owner.
- The platform does not provide legal, tax, financial or appraisal advice. Help Center guides are general information; for a specific decision, consult a notary, lawyer, licensed appraiser or financial institution.
3. User accounts
- You must be over 18 to create an account and must provide true, up-to-date information.
- Accounts are personal. You are responsible for your password and second authentication factor, and for everything done with your account.
- Team and agent accounts require two-step verification. CARACOL may end active sessions when it detects a security risk.
- Tell us immediately if you suspect unauthorised use of your account.
4. Property information
Each listing is published from information provided by the owner, their representative or the responsible agent, and is reviewed by a person before publication.
- Prices, measurements, availability and features may change without notice and must be confirmed with CARACOL before making a decision.
- For the owners' safety, the map shows an approximate area (a circle), not the exact address, which is shared once a viewing is confirmed, unless the owner has authorised publishing the exact location.
- Listings labelled "demonstration" illustrate how the platform works and are not a commercial offer.
- Images may carry the CARACOL watermark and be optimised for publication without changing what they show.
5. Viewing requests, contact and offers
Viewing requests, messages and enquiries sent through the platform, WhatsApp or chat are requests, not bookings or acceptances. A CARACOL team member confirms them. No request obliges the owner to sell or lease, or you to buy or rent.
The chat's automated assistant (Agente Caracol) guides you with published information and can make mistakes. Its answers are not offers, commitments or advice; when needed it will hand you over to a person.
6. Prohibited uses
When using the platform you agree not to:
- Publish false or misleading information, or list property you are not entitled to market.
- Impersonate another person, agent or company.
- Use listing information to contact an owner in order to bypass CARACOL's brokerage in a deal CARACOL introduced to you.
- Copy, extract or reproduce listings, photographs or texts in bulk, manually or automatically (scraping, bots), except search engines that respect our robots.txt.
- Attempt to breach the platform's security, access other people's accounts or interfere with its operation.
- Use the platform for unlawful purposes, including money laundering, or to send unsolicited advertising.
7. Intellectual property
The CARACOL brand, the snail logo, the platform design, editorial texts, guides and software belong to CARACOL or are used under licence. You receive a limited, personal, non-exclusive and revocable licence to consult the platform for the purpose of searching for property. Any other use requires written authorisation.
8. Content you provide
If you publish or send us photographs, videos, descriptions or documents, you represent that you are entitled to do so and grant CARACOL a non-exclusive, royalty-free licence, for as long as the property is marketed (and as needed to keep the record), to publish them, adapt them to the platform's formats, add the watermark and share them on CARACOL channels. You keep ownership of your content.
9. Tools and estimates
Financing calculators, estimates and Observatory readings are for reference only. They are not a credit offer, an appraisal or an investment recommendation.
10. Third-party services
The platform uses third-party services (maps, messaging, hosting, storage). Links to external sites are provided for convenience; CARACOL is not responsible for their content or policies.
11. Liability
CARACOL strives to keep information accurate and the service available, but the platform is provided "as is". To the extent permitted by Honduran law, CARACOL is not liable for:
- Decisions based solely on published information, without the checks we recommend.
- Acts or omissions of owners, buyers, tenants or other third parties.
- Interruptions, errors or data loss caused by third-party failures or force majeure.
Nothing above limits the non-waivable rights granted to you by consumer protection or tenancy laws.
12. Indemnity
You will hold CARACOL harmless from third-party claims arising from content you publish or from your use of the platform in breach of these terms.
13. Suspension and closure
CARACOL may suspend or close accounts and remove listings or content when they breach these terms, when information cannot be verified or when the law requires it. You may close your account at any time by writing to info@caracolhn.com.
14. Privacy
The processing of your personal data is governed by the Privacy Policy and the Cookie Policy, which are part of these terms.
15. Changes
We may update these terms. Each version is recorded in the Trust Center with its date. Changes apply from publication and do not affect transactions already formalised.
16. Governing law and disputes
These terms are governed by the laws of the Republic of Honduras. Before any other step, the parties will try in good faith to resolve a dispute for thirty (30) days from the affected party's written notice. Failing that, they submit to the competent courts of Tegucigalpa, Municipality of the Distrito Central, without prejudice to the non-waivable rights the law grants consumers or tenants. If this English version and the Spanish version differ, the Spanish version prevails.
