Version 2026-09 · v1
Terms for owners and agents who list
These conditions apply to anyone who lists or markets property through CARACOL: owners, attorneys-in-fact and network agents. They complement the Terms and conditions of use.
Requirements to list
- Prove identity and the right to market the property (deed or registry certificate, power of attorney or the owner's written authorisation).
- Provide complete and true information: price, measurements, condition, utilities, known encumbrances and any condition relevant to a buyer or tenant.
- Sign the marketing authorisation or the applicable brokerage agreement.
Fees and exclusivity
- Brokerage fees, on sales and on leases, are negotiated between the parties and agreed in writing in the brokerage agreement or the marketing authorisation before promotion begins. CARACOL charges no fee that is not set out in that document.
- Exclusivity, its term and the promotion plan are agreed in the contract.
Non-circumvention
During the contract and the protection period after it ends (as set in the brokerage agreement), the owner agrees to deal through CARACOL with any interested party CARACOL introduced. If the transaction closes without CARACOL, the agreed fees become due.
CARACOL agent code of conduct
- Always tell the truth about the property, even if it costs a sale.
- Never charge unagreed amounts or personally receive money from the transaction.
- Protect the data and safety of owners and interested parties; never share exact addresses or when owners are away.
- Disclose any conflict of interest, including personal or family interest in the property.
- Accompany viewings and act with respect, punctuality and without discrimination.
- Follow anti-money-laundering rules: identify the parties and report unusual transactions to the compliance team.
Breaches
CARACOL may remove listings, suspend access to Oficina or end the relationship with anyone who breaches these conditions, without prejudice to the applicable legal actions. If this English version and the Spanish version differ, the Spanish version prevails.
