Version 2026-09 · v1
Privacy policy
This policy explains what personal data CARACOL processes when you use www.caracolhn.com, write to us, list a property or work with us; what we use it for; who we share it with and how you can exercise your rights. We wrote it to be understood: if anything is unclear, ask us.
1. Data controller
Caracolhn, trading as CARACOL Real Estate or Bienes Raíces Caracol, tax ID (RTN) pending registration, registered address in San Pedro Sula, Honduras. Privacy contact: info@caracolhn.com.
2. Legal framework
The Constitution of the Republic of Honduras guarantees the right to personal and family privacy and to one's own image (article 76) and the habeas data guarantee (article 182, amended by Legislative Decree 237-2012), which allows anyone to access information about themselves held in public or private records and, where appropriate, to update, correct or delete it. This policy puts those rights into practice and also adopts international data protection practices that we apply to every user, wherever they live.
3. What data we process
If you visit or write to us
- Name, email, phone or WhatsApp and the message you send through contact forms, viewing requests, sell requests or chat.
- Preferences you choose to share (area, budget, property type) and, only with your express consent, optional financial context.
- Your chat conversation, including what you write to the automated assistant.
If you have an account
- Name, email and role. Your password is stored with one-way encryption (nobody, including CARACOL, can read it). The two-step verification secret is stored encrypted.
- Session records: date, device and approximate IP address, to protect you from unauthorised access.
If you list or entrust a property to us
- Property data, photographs, documents proving your right to market it and your contact details.
- The property's exact location. We do not publish it: the site shows an approximate-area circle unless you authorise otherwise.
- We remove location (GPS) and device metadata from photographs before storing them.
If you are an agent or team member
- The professional verification data you provide (identification and professional background), reviewed privately.
Technical data
- Server logs (IP address, browser, requested pages and errors) needed to operate and protect the platform.
- Cookies and local storage, described in the Cookie Policy. We do not use advertising or third-party tracking cookies.
4. What we use your data for
- Answering your enquiries, arranging viewings and following up your request (performance of your request).
- Marketing the property you authorised us to promote (performance of the brokerage agreement).
- Managing your account and protecting the platform's security (legitimate interest and service performance).
- Complying with legal, accounting, tax and anti-money-laundering obligations that apply to us.
- Sending you CARACOL commercial information only if you consented; you may withdraw that permission at any time.
We do not make decisions with legal effects on you based solely on automated processing.
5. Who we share data with
We do not sell or rent your personal data.
- Within a transaction: the assigned agent and, when you request it, the owner or the interested party, with the minimum data needed to arrange a viewing or a negotiation.
- Service providers that process data only on our instructions: site hosting (Vercel), database (Neon), file storage (Cloudflare), messaging (WhatsApp, when you use it) and artificial intelligence providers that process chat messages to generate answers.
- Maps: when you view a map, your browser downloads images from OpenStreetMap, which receives your IP address.
- Authorities: when there is a legal obligation or an order from a competent authority.
6. International transfers
Some of our providers host data outside Honduras, mainly in the United States. We choose providers with recognised security measures and require them to keep data confidential.
7. How long we keep data
- Enquiries and requests with no transaction in progress: up to 24 months from the last interaction.
- Accounts: while active; when closed we delete or anonymise the data, except what the law requires us to keep.
- Security logs: up to 12 months.
- Records of closed transactions: the period required by commercial, tax and anti-money-laundering laws.
8. Security
Encrypted connections (HTTPS), passwords protected with one-way encryption, two-step verification for the team, role-based access, revocable sessions and backups. No system is infallible: if we detect an incident affecting your data, we will tell you without undue delay.
9. Your rights
At any time and free of charge you may:
- Access the data we hold about you.
- Ask for it to be corrected or updated.
- Ask for its deletion, unless the law requires us to keep it.
- Object to the use of your data for marketing and withdraw any consent you gave.
- Receive your data in a commonly used format.
Write to info@caracolhn.com with your request. We may ask you to verify your identity. We will reply within fifteen (15) business days. If you are not satisfied, you may exercise the habeas data guarantee before the Constitutional Chamber of the Supreme Court of Justice.
10. Minors
The platform is not intended for people under 18 and we do not knowingly collect their data. If you believe a minor has given us information, write to us and we will delete it.
11. Changes to this policy
We will publish each new version in the Trust Center with its date. If a change is significant, we will highlight it on the site. If this English version and the Spanish version differ, the Spanish version prevails.
